Administrative law, particularly in the area of professional regulation, is changing rapidly; how can regulators keep current with evolving trends? How can we predict the evolving issues that are likely to affect our regulatory bodies? Which guidelines and principles can prove most useful for formulating the mandate and jurisdictional limits of a regulatory body? How might we best anticipate the procedural fairness obligations that will apply to our regulatory processes, and determine how to demonstrate our accountability for them?
In this course, Richard Steinecke, BA, LLB introduces nonlawyers to the principles and concepts of Canadian administrative law in the context of regulating a profession. Participants will learn the most effective methods to ensure that they act in accordance with their mandate in a procedurally fair manner.
Course Objectives
By the end of this course, participants will be able to:
- Formulate the mandate and jurisdictional limits of your regulatory body
- Predict the procedural fairness obligations that apply to your regulatory processes and determine how accountability will demonstrated for them
- Construct the scope, purposes and processes for making your rules and policies
- Predict the evolving issues and trends that are likely to affect your regulatory body
